Abstract

The article examines, in the second part of the study, the organized and commented case law on criminal enforcement, covering prison regime, progressive system, heinous crime, temporal and subjective requirements, open regime, regression, remission and serious misconduct. The exposition gathers judicial opinions and doctrinal notes, indicating that progression is the rule and stagnation the exception, with enforcement bodies bound to implement it. The investigation shows disagreement regarding the legal prohibition of progression in heinous crimes, with superior courts upholding its constitutionality, and discusses the nature of the temporal requirement, the merits and the consequences of serious misconduct.
