Abstract

The article examines the punctual penal reforms that have occurred in Brazil since the reform of the general part of the Penal Code in 1984, and argues that this method has been responsible for many missteps. The exposition states that it is impossible to build new codes within the current legislative process and notes that Law 9,099/95, on Special Courts, constitutes an exception by introducing decriminalizing institutes. The text analyzes widespread violence in large cities, the absence of ideological perspectives in the globalized economy, and a divided, multifaceted society. The investigation criticizes Law 9,034/95 and the Heinous Crimes Law, pointing to an inversion of values in Law 9,426/96. The conclusion proposes a permanent penal reform commission.
