Abstract

The article examines the punitive system established by the Brazilian Traffic Code, analyzing the penalties of article 256, among written warning, fine, suspension of the right to drive, revocation of the license, and mandatory attendance in a recycling course. The exposition distinguishes the fine penalty from suspension of the right to drive, which requires an administrative process with full defense, and examines the retention of the license, the seizure and removal of the vehicle, revocation, and the administrative measures of article 269. The text analyzes the scoring system, the twelve-month computation, and refusal to submit to the alcohol test. The investigation concludes that refusal is not punishable under Brazilian law.
