Abstract

The article examines the doctrinal and legislative divergences regarding the determination of the legal interest of the money laundering offense. The methodology used is the critical and comparative analysis of doctrine and legislation, starting from the 1988 Vienna Convention. The exposition examines the theses of the socioeconomic order, the circulation of goods in the market and the administration of justice, demonstrating that the first two do not hold due to their breadth or the uncertainty of the result. The investigation concludes that the protected legal interest is the administration of justice, since the conduct obstructs the punishment of the predicate offenses.
