Abstract

The article examines controversial issues of the National Traffic Code, concerning composition and transaction, substitution of penalties, judicial pardon, omission of assistance, fleeing the accident scene, driving without a license, drunk driving and violation of suspension or prohibition. The methodology used is the dogmatic and interpretive analysis of the Traffic Code provisions, in confrontation with the Criminal Code and Law 9,099/95. The exposition examines the constitutionality of composition and transaction, the requirement of danger of harm in the crimes of driving without a license and drunk driving, and the proof of alcohol levels. The investigation concludes by the validity of the decriminalizing institutes and the survival of the misdemeanor only as to vessels.
