Abstract

The article comments on a judgment of the Court of Justice of Ceará that granted habeas corpus to terminate criminal proceedings for the ineptitude of the indictment and lack of just cause. The methodology used is the jurisprudential and doctrinal analysis of the writ's admissibility, the ineptitude of the accusatory piece and the reasoning of decisions. The exposition examines imputation by logical induction, the atypical nature of past drug use and the decisory nature of the indictment's receipt. The investigation concludes that the act of receiving the indictment is an interlocutory decision that requires reasoning, under penalty of absolute nullity.
