Abstract

The article examines Law 9,296/96, which regulates telephone interception, its concepts, legal nature, requirements and limits. The methodology used is the dogmatic and constitutional analysis of the Constitution, the law, doctrine and case law. The exposition covers the constitutional view, the concept and precautionary nature of the measure, the impeditive causes, legitimacy, time limit, transcription, deferred adversarial proceedings and intertemporal law. The investigation concludes that interception is an exceptional precautionary measure, admitted only in crimes punishable by imprisonment and subject to judicial control.
