Some considerations on the crime of misappropriation of social security contributions, provided for in letter d of art. 95 of Law 8,212/91

This article offers some considerations on peculiar aspects of Law 8,212/95, which in its art. 95, d, describes the offense of misappropriation of social security contributions deducted from employees but not transferred, within the legal term, to the coffers of the National Social Security Institute - INSS. Among other problems, those relating to the objective requirements for the completion of the criminal type are addressed, as well as the institutes of necessity and the inexigibility of different financial conduct. Finally, the error in the publication of the sole paragraph of art. 11 of Law 6,939/98 is analyzed, which granted amnesty to political agents held responsible, without such being their legal attribution, for the practice of the crimes provided for in letter d of art. 95 of Law 8,212/91, and in art. 86 of Law 3,807/60.
