Abstract

The article analyzes the nullity arising from the improper summoning of jurors for a jury trial, based on a case heard by the 1st Jury Court of the Capital. The discussion presents the grounds of appeal alleging a violation of the principle of the natural judge and the defense’s right to know the jurors in advance. The text examines the statutory requirements for composing the Jury Council and emphasizes that, when the minimum quorum was not reached, the judge should have scheduled a new session rather than summon jurors selected for another courtroom. The appellate decision recognized absolute nullity and annulled the trial.
