Abstract

The article examines the judge's evidentiary initiative in the accusatory criminal process, distinguishing the accusatory system from the adversarial system. The methodology used is the dogmatic and comparative analysis of criminal and civil procedural law, with examination of doctrine and legislation. The exposition covers the meaning of the accusatory system, the publicist conception of the process, the limits of official evidentiary activity and the distinction between real truth and formal truth. The investigation concludes that the judge must have evidentiary initiative, respecting the adversarial system, reasoning and the lawfulness of evidence.
