Abstract

The article comments on a Supreme Federal Court judgment regarding the conditional suspension of proceedings, provided for in article 89 of Law 9,099/95, and the refusal of the Public Prosecution Service to propose the benefit. The exposition examines the vote of the rapporteur, of the rapporteur for the judgment and of the reviewing justice, discussing the consensual nature of the institute, the power-duty of the prosecuting body and the possibility of analogous application of article 28 of the Code of Criminal Procedure. The investigation adopts the methodology of jurisprudential and doctrinal analysis. The text concludes that the refusal must be reasoned and submitted to the Attorney General's Office, also examining judicial activism.
