Abstract

The lay judge must enforce the guarantee of due process of law in jury procedure. The influence of the Law and Order doctrine has found facilitation in the inconsistency of the notions and concepts applied in the jury. The author draws attention to the inflationary crisis of aggravating circumstances in creative indictments. The author demonstrates how vague and devoid of meaning the concepts and notions used are, suggesting a scheme for analyzing aggravating circumstances that guides not only the indictment, but also the libel and the questioning, in order to ensure a fair trial.
