Abstract

The article examines, in an opinion, the devolutive effect of the special appeal, typicality and juridical possibility in criminal procedure, the assertion theory and the return of the case to the a quo Court for judgment on the merits. The exposition adopts the methodology contained in the text, based on doctrinal and jurisprudential analysis. The investigation starts from a consultation formulated in a criminal action in which the consul was convicted at first instance and acquitted by the Federal Regional Court on the ground of the atypical nature of the conduct, the Federal Public Prosecution Service having filed a special appeal, known and granted to restore the singular sentence. The opinion analyzes the generic delimitation of the devolutive effect, the purposes and admissibility requirements of the special appeal, in particular the prior question, the judgment of the case and the application of the law to the species, typicality and juridical possibility in criminal procedure and the divergence in the judgment of the appeal, concluding that the Superior Court of Justice could not have directly restored the first-instance condemnatory sentence, and that the case must return to the Federal Regional Court for judgment of the residual matter concerning the exclusion of culpability.
