Abstract

This text aims to propose an interpretation of art. 327 of the Criminal Code through the methodology proposed by Francesco Iacoviello, based on Popper's thought. The proposed hypothesis is that both the direct administration and the foundations instituted by the public power, the mixed-capital companies, the public companies and the autarchies, as well as the employees of the former and the latter, may be passive subjects of crimes against the public administration.
