Abstract

The article presents and criticizes 15 appellate decisions from the period 1988-1998 in which the defense of honor was invoked in crimes of passion against women. It criticizes culturalist arguments that the reaction would be socially legitimate. The hypothesis is not provided for in law and decisions that transcend it are only legitimate if they serve to guarantee people's rights. On the contrary, the defense of honor contravenes principles of justice and human rights, expressed in international legal instruments.
