Abstract

The article comments on the judgment of Criminal Appeal 272.550-3/0, of the 5th Criminal Chamber of the Court of Justice of São Paulo, which acquitted members of the Landless Rural Workers Movement of the accusation of criminal gang and qualified theft. The exposition analyzes the decision that rejected the typicity of possessory esbulho due to the absence of the specific subjective element, as well as the impossibility of attributing to all participants the acts of violence practiced by some, in light of the prohibition of objective criminal liability. The investigation concludes for the technical correctness of the judgment and highlights its contribution to the understanding of the struggle for agrarian reform as an expression of citizenship.
