Keywords:
Prejudice, Witness, Homosexual, Testimonial evidence, Principle of equalityAbstract
The article comments on the judgment of Special Appeal 154,857/DF, of the Sixth Panel of the Superior Court of Justice, which recognized the capacity of homosexuals to testify, rejecting restrictions based on prejudice. The exposition examines the historical evolution of oral evidence and the overcoming of restrictions on slaves, foreigners, prisoners and prostitutes, concluding that the modern requirement for testifying is the absence of interest in the outcome of the process. The investigation maintains that the word of the homosexual deserves the same credit as that of the heterosexual, in fulfillment of the principle of equality.
