Abstract

The object/problem of this article is about the meaning of the legal concept for the punishment from the "government criminality on the East Germany" and its controversial compatibility with the legal-penal prohibition of retroactivity. The problem is investigated under the light of the known Radbruch formula, which gained extraordinary relevance on the judicature and on the scientific literature regarding the "coping with the past". It is concluded at the end that the success of the above mentioned formula is a result of its scientific weakness, especially its semantic indetermination.
