Abstract

The article examines the distinction between types of criminal seizure in Brazilian law. The author analyzes the legislative evolution from Decree-Law 3,240/41 to the 1941 Criminal Procedure Code and Law 8,429/92. The author demonstrates that Decree-Law 3,240 was tacitly revoked by the CPP, which now regulates the matter in arts. 125, 132, 136 and 137. The author differentiates seizure of assets acquired with proceeds from the offense (arts. 125 and 132) from prior seizure for legal mortgage (art. 136). Both modalities require indication and specification of assets, strong evidence of illicit origin or certainty of the offense and sufficient evidence of authorship, in addition to the presence of fumus boni iuris and periculum in mora.
