Abstract

The article examines the use of a toy gun in the crime of robbery as a special cause of penalty increase, in light of Law 9,437/97 and Precedent 174 of the Superior Court of Justice. The exposition analyzes the new criminal type that incriminates the use of a simulacrum of a weapon capable of frightening others to commit crimes, examining its objective, normative and subjective elements. The investigation sustains, with support from Fontan Balestra, Quintano Ripollés and Sebastián Soler, that the toy gun is capable of characterizing robbery, but not aggravated robbery, since the concept of weapon requires real vulnerable power. The text concludes that the criminal type of Law 9,437/97 is absorbed by the caput of article 157 of the Criminal Code.
