Abstract

The article examines the justification of the right to punish in Luigi Ferrajoli's work Derecho y razón and formulates critical objections to his guarantist model. The methodology used is the theoretical-critical analysis of the author's work, with examination of his concepts and empirical premises. The exposition covers the foundation of the right to punish, the double preventive function of the penalty, the model of minimal and guarantist criminal law and the criticisms of preventive effectiveness. The investigation concludes that the problem of legitimizing the penal system remains open, requiring criminological and criminal-political deepening.
