Abstract

The article examines the police inquiry in light of the individual rights and guarantees of the 1988 Federal Constitution, starting from the distinction between democracy and democratization and from the role of the Civil Police in this process. The exposition analyzes the concept and purpose of the inquiry, proposing its understanding in two distinct investigative moments, the first aimed at confirming the offense and its circumstances and the second at the formal accusation. The investigation adopts the methodology of doctrinal and normative review, with analysis of the Code of Criminal Procedure, the Constitution and administrative and procedural doctrine. The text supports the requirement of motivation for the acts of the police authority and concludes that the inquiry must conform to the defense of citizenship and human dignity.
