Abstract

This article aims to address some aspects of Brazilian criminal practice, in light of the discussion on criminal procedure. Highlighting the difference in meanings among social jurists, the concept of "inquisitorial" and the roles played by the Civil Police and the Public Prosecution Service are analyzed in order to build the argument that the double-instruction model ends up having an ambiguous character and ultimately allows the reproduction of the unequal application of law and violence, in terms of socioeconomic and demographic conditions.
