Abstract

Through bibliographical research, this paper analyzed Article 146-A of the Brazilian Penal Code, introduced by Law 14.811/24, which criminalized bullying and cyberbullying. The development started with the definition of the term systematic intimidation, with subsequent examination of the legal objectivity and classification of the type within the penal system. The conclusion is that, despite legislative atechnicality leading to misunderstanding of Article 146-A, the type is a crime and not a misdemeanor, with the possible practical consequence of its premature disuse.
