Unconstitutionality, Complementary Law No. 1.398/2024 of the state of São Paulo, ADI 7662 (STF), Amicus curiae, IBCCRIMAbstract
On June 12, IBCCRIM requested admission as amicus curiae in ADI 7662 (STF), which seeks a declaration of unconstitutionality of the law that, in the state of São Paulo, implemented the so-called "Civic-Military Schools". The Institute's statement deals with the formal unconstitutionality of the state project, as well as taking into account the democratization of the Brazilian state based on the new constitutional order, the appreciation of basic education professionals, the rights of children and adolescents, who are subjected to military-like institutions at an early age, and questions the attribution of anomalous functions to the military forces, in violation of art. 144 of the Federal Constitution.
