The article questions the employment of “concret gravity” as an argument to support pre-trial detention. Initially, it contextualizes the relevance of thinking about strict criteria for the imposition of this precaution given the scenario of crisis in the prison system and the need to reconcile this institute with the doctrine and criminal procedural law. Next, it argues that this thesis, in line with forensic practice, conflicts with the principle of provisionality and with the demands of actuality of the facts that give rise to them. Lastly, it aims to interpret the “concret gravity” considering the requirements discussed in HC’s 143.333/STF.
