The judge's investigatory powers in criminal proceedings are often linked to the inquisitorial model, based on concerns about judicial impartiality. This study examines their compatibility with the accusatorial system, which separates the roles of prosecution, defense, and judgment. Rather than focusing on evidentiary means, it distinguishes the Accusatorial and Inquisitorial Systems by whether prosecution and judgment functions are combined. It also explores the differences between Adversarial and Non-adversarial Systems, highlighting the judge's role in evidence production. The study concludes that a restricted and complementary investigatory initiative aligns with the accusatorial model, as it does not inherently blur the roles of prosecution and judgment.
