The criminal nonprosecution agreement during the execution of the custodial sentence

This article analyzes the retroactive application of the Criminal Non-Prosecution Agreement, taking as a starting point the decision of the Brazilian Supreme Federal Court in Habeas Corpus 185,913, which limited the possibility of entering into the agreement up to the final and unappealable conviction. A broader interpretation is advocated, one that includes individuals in the execution phase of criminal proceedings, thereby upholding the principle of retroactivity of the more lenient criminal law and ensuring the benefits granted to those within the scope of Criminal Enforcement.
