The need for motivation in generic prison decrees in light of the Anticrime Package (Law 13,694/2019)

The article examines the amendments introduced by Law 13,694/2019 (the “Anticrime Package”) to the Brazilian Code of Criminal Procedure, in alignment with the constitutional guarantee established in Article 93, IX, of the Federal Constitution. The legislative reform underscores the duty to provide adequate reasoning in judicial decisions ordering or upholding pretrial detention. Particular attention is given to the inclusion of paragraph 2 in Article 315 of the Code, which explicitly defines scenarios that characterize insufficient reasoning, such as generic, formulaic justifications, or those disconnected from the specific factual context. To illustrate the practical implications of these requirements, the article discusses recent rulings from the Federal Supreme Court and the Superior Court of Justice that address the lack or inadequacy of judicial reasoning in preventive detention orders.
