This article aims to conduct a brief legislative, jurisprudential and doctrinal analysis on the defense intervention in investigative acts, either in the police investigation, or in procedures performed by other authorities. The overview starts from a constitutional analysis of the article 7, XXI, OAB (Brazilian Bar Association) Statute, introduced by Law 13,245/2016, comparing it with the ongoing reform project in the realm of the Brazilian criminal procedure law.
