The Alvarado Espinoza Case and the parameters for Armed Forces involvement in public security

Over 40 years of existence, the Inter-American Court of Human Rights has aimed to establish juridical standards related to structural patterns of human rights violations. The case of Alvarado Espinoza v. Mexico, sentenced in 2018, reveals that enforced disappearances and violations of human rights by the Armed Forces are still on the agenda of the Inter- American Court. However, with the institutional consolidation of democratic regimes in Latin America, these themes have been reinterpreted and now appear in the context of public security policies. In Alvarado case, the Court stated that public security policies cannot deny the rights enshrined in the American Convention on Human Rights and that the participation of the Armed Forces in public security can only occur exceptionally and subordinated to civil authorities.
