We have witnessed setbacks in human rights in the Brazilian criminal justice system, including the relativization of the presumption of innocence, impartiality, and the fight against institutional violence. Custody hearings, instituted to reduce pretrial detention and oversee arrests, have been the target of jurisprudential arguments that weaken procedural guarantees, such as legal deadlines, nullities, and the role of flagrante delicto. Research shows negligence in reports of torture, ineffectiveness of the judiciary and the Public Prosecutor's Office, and racial discrimination. Such practices compromise the constitutional principle of due process and threaten the fundamental rights of those in custody.
