Abstract

The Federal Supreme Court (STF) consolidated its understanding in HC 127.483/PR, recognizing plea bargaining as a highly personal legal transaction, which prevents third parties who have been denounced from questioning its validity. However, in HC 151.605/PR, the Court relativized this position by admitting the challenge of agreements that violate jurisdictional prerogatives, as in the case of governors. Legal doctrine, in turn, has defended the possibility of judicial review of agreements, especially when they affect the fundamental rights of the accused, such as the right to a fair hearing and full defense. This perspective aims to ensure the legality and effectiveness of plea bargaining in criminal proceedings.
