This article aims to discuss the changes introduced by Law 15,272/2025 to the institute of preventive detention, focusing on the constitutional principle of the presumption of innocence. Thus, through a qualitative analysis based on a bibliographic and documentary review, it was concluded that Law 15,272/2025 constitutes yet another instrument for increasing incarceration in the country, completely disregarding the legal limits outlined by the presumption of innocence.
