Understanding beween authorship and attribution in light of Claus Roxin’s studies

This article examines the recurring confusion between authorship and attribution in criminal law, particularly following the application of the theory of control over the act in the judgment of Criminal Case No. 470. Based on the functionalist theory of Claus Roxin, the study argues that the determination of authorship must not be conflated with the criteria for attributing criminal liability. It analyzes the forms of authorship developed by Roxin—direct authorship, indirect authorship, functional coperpetration and control over an organization—highlighting the specific requirements of the latter. The article then discusses the concept of objective attribution as a distinct normative method for linking conduct and result. It concludes that maintaining a clear conceptual distinction between authorship and attribution is essential to prevent interpretative distortions and to ensure greater theoretical and evidentiary rigor in criminal adjudication.
