Incompatibilities of art. 2, § 9, of Law 15,358/2026 with the legal framework governing pretrial detention

The present article analyzes the compatibility of Article 2, § 9, of Law 15,358/2026 with the constitutional model of pretrial detention in Brazilian criminal procedure. It examines whether the provision of “legal sufficiency” for the decree of preventive detention complies with the requirement of concrete judicial reasoning established by the Federal Constitution and the Brazilian Code of Criminal Procedure. The study addresses the exceptional nature of pretrial detention, the constitutional duty to state reasons in judicial decisions, and the prohibition of precautionary automatism based on abstract presumptions of dangerousness. It argues that replacing the concrete demonstration of periculum libertatis with normative presumptions of dangerousness weakens the accusatorial structure of criminal procedure and undermines the exceptional character of personal precautionary measures.
