This article proposes an analysis of economic criminal law from the standpoint of historical-dialectical materialism. Drawing on Marxian categories such as civil society, ideology, commodity fetishism, money, surplus value and primitive accumulation, it argues that economic crime should not be understood merely as individual deviance from a neutral economic order. Many economic offenses express contradictions internal to the capitalist rationality of valorization, competition and accumulation. Economic criminal law thus operates ambiguously: it may hold economic power accountable, but it may also legitimize the normality of the market by treating structurally rooted practices as exceptional deviations.
