This paper analyzes the reasonable suspicion provided for in Article 244 of the Brazilian Criminal Procedure Code as a requirement authorizing personal searches, considering the recent designation of Themes 1438, 1439 and 1441 for judgment under the repetitive appeals procedure by the Third Section of the Superior Court of Justice. To this end, it reflects on the vagueness of the concept, which generates legal uncertainty for both the public agent and the citizen, converting a legal filter into a mechanism of criminal selectivity. It adopts the deductive method, with a qualitative approach, through bibliographic review and analysis of rulings of the Brazilian Superior Courts, compared with decisions of United States courts. In conclusion, it is observed that establishing objective criteria for the clause rationalizes and constitutionally legitimizes police action, restoring to Article 244 of CPP the requirement that the suspicion be, in fact, well-founded.
