Indemnifications for unjust imprisonments
a pilot study on civil liability of the State in the Court of Justice of Paraná

This article presents the preliminary results of a pilot study on the granting of civil indemnities in cases of materially unjust provisional or definitive imprisonment within the Court of Justice of Paraná. The research analyzed 46 judgments of Civil Appeals between July 2020 and July 2025, of which 43 contained information about imprisonment time. The data reveal an average of 65.44 days of unjust imprisonment (approximately 2 months and 5 days), with an average indemnity of R$ 25,000.00, corresponding to R$ 382.00 per day of imprisonment. Banal errors in the prison regime and problems in identifying people continue to determine unjust imprisonments, while financial reparations hardly compensate for the lost lifetime. The study highlights the urgent need for improvement in the evaluation of memory-dependent evidence.
