Abstract

The “natural judge” is a constitutionally provided guarantee to avoid “bogus” proceedings and ensure that the court most suited to the matter evaluates, processes and judges the case. However, it is necessary to question the validity of the acts performed by incompetent courts and their treatment before the Brazilian Superior Courts. That is what this section is concerned with exploring.
