The arrest in the sentence and the prevalence of the art. 387, §1, of the CPP

The preventive detention decreed or maintained in the sentence must have a precautionary nature and be contemporaneous. If these qualities are not present, it will be in breach of art. 387, §1, of the CPP, as well as arts. 5, LVII, and 93, IX, of CF/88. The per relationem reasoning does not authorize the absence or deficiency of reasoning nor the provisional execution of the sentence.
