Abstract

The paper presents a critical approach, from a criminological standpoint, about the new system of execution of criminal fines established by decision of the Brazilian Supreme Court. Based on theoretical research and data obtained by the Public Defender’s Office of São Paulo from the Court of Justice of São Paulo, it appears that the alteration of the competence and of the legitimated actor for the execution, as well as the non-declaration of extinction of the penalty, even after the fulfillment of the main sentence, has been generating a contingent of marginalized persons, unable to exercise their political rights, to claim for assistance benefits, as well as to obtain any formal job, given the absence of electoral acquittal and declaration of extinction of the penalty.
