Criminal liability and the limitation of guilt in claus roxin’s teleological functionalism

Since crime is present in the most remote societies, it has been considered a social fact, which has led to the evolution of criminal law and, consequently, the application of penalties. In this context, Claus Roxin's Teleological Functionalist system emerges from an evolving, limiting Criminal Law and a new proposal, which does not close its eyes to social reality itself, which for a long time was seen as a pre-constituted and immutable object. In this way, this work is developed in the study of the German Penalist's proposal, especially with regard to the effectiveness and legitimacy of the state's actions within the scope of Criminal Law, the balance of the preventive, special and general functions of penalties, in which the political-criminal purposes are praised as overcoming the mere normative production of what is considered illicit.
