In 2011, the Brazilian Supreme Court recognised the general repercussion regarding the typical nature of drug possession for personal use. The leading case was Extraordinary Appeal 635.659, in which the São Paulo Public Defender's Office raised the unconstitutionality of article 28 of Law 11.343/06, in a case involving the possession of a small amount of cannabis.
