This article aims to analyze the theoretical and dogmatic assumptions of the so-called product criminal liability in the context of the improper omission. The discussion concerns on three of its fundamental corollaries: causality, the guarantor and subjective liability. The interest of such reflection comes from the analysis of the Cervejaria Bäcker recent case in Belo Horizonte-MG.
