The recent changes promoted in art. 122 of the Penal Code have led to numerous problems, of which, in this article, only one stands out, concerning the scope of the crime in its simple form and its delimitation towards the qualified form provided in art. 122, par. 1. It is assumed that the solution to the problem lies, on the one hand, in the concept of self-mutilation and in the systemic position of the norm within the Penal Code, and, on the other hand, in the subjective element and the purpose of the conduct
