The Anti-Crime Package brought important changes to the brazilian Criminal Procedure Code – CPC. As for the changes promoted on the theory of the criminal evidence, it is noted that the legislator sought, as an expression of the accusatory system, to give priority to the impartiality of the judge. Through an analysis of the current procedural rules and the collection of bibliographic material, the study aimed to understand the real need for the insertion of § 5º in art. 157 of the CPC. It has been clear to understand that, although it tries too much to give primacy to the principle of impartiality, the changes arising from the Anti-Crime Package on the subject related to the theory of evidence in criminal proceedings are in conflict with other principles of Criminal Procedure Law of equal importance. It is clear that this provision is unreasonable in criminal proceedings in the search for a fair decision.
