This article deals with the institute of the Penal Non-Persecution Agreement (CNPA), introduced by the Law 13.964/2019. The CNPA is a manifestation of consensual law in the Brazilian Criminal Procedure and it intends to contribute for making clauses, based on three axes: 1- to monitorate the accusation excess; 2- ensure proportionality in the case; 3- look for the integrative negotiation.
