Abstract

The author examines the interaction between the Special Criminal Courts, created by Law 9,099/95, and crimes against the economic and tax order and consumer relations. It aims to verify which of these offences, given the competence established in numerus clausus, may be tried before the Special Courts, considering a maximum penalty not exceeding one year and the absence of special procedure. It highlights that the laws defining economic crimes do not provide for offences with a penalty below one year, except the Consumer Defence Code, whose offences, as a rule, fall within the jurisdiction of the Special Courts. It concludes that the new law had little impact on economic crimes, whose perpetrators continue to be tried in ordinary courts.
