Abstract

The author examines the applicability of Law 9,271/96, which amended articles 366 to 370 of the Code of Criminal Procedure, to ongoing proceedings, especially regarding the new wording of article 366, which orders the suspension of the proceedings and of the limitation period when the accused, summoned by notice, fails to appear or appoint a lawyer. It aims to demonstrate that the norm has a mixed nature, substantive and procedural, and cannot be partially applied, as that would create a third law. It analyses the tempus regit actum principle, the non-retroactivity of harsher law and the prohibition of taking advantage of one's own wrongdoing. It concludes that the law does not affect cases prior to its entry into force.
